These Terms set out the rules under which a Creator may receive voluntary Support from Viewers in the BEON.RUN service. They supplement the Service Terms. Enabling Support requires accepting this document; every new version requires renewed acceptance.
§ 1. Parties and definitions
- The Provider (also “BEON.RUN”) is Radosław Balcerzak, balcerzak.it RADOSŁAW BALCERZAK, NIP 7631978291, REGON 300843692, ul. Słoneczna 11/B, 64-730 Rosko, Poland, e-mail [email protected].
- Support Recipient – a User who meets the conditions in § 2 and has enabled the Support feature.
- Supporter – a person making a Support payment.
- Support – a voluntary payment by a Supporter to a Support Recipient, related to their public Activities, Streams or profile.
- Stripe – the payment services provider (Stripe Connect) with which the Support Recipient concludes a separate agreement.
- Stripe Account – the Support Recipient's connected account at Stripe.
- Platform fee – BEON.RUN's remuneration set out in § 5.
§ 2. Who can become a Support Recipient
- A User can become a Support Recipient if they, cumulatively:
- are an adult (at least 18 years old) with full legal capacity – confirmed by a declaration;
- have an active Account in good standing (not suspended or banned);
- have accepted these Terms;
- have created a Stripe Account and accepted the Stripe agreement (the Stripe Connected Account Agreement and the Stripe Services Agreement or other terms indicated by Stripe);
- have passed the verification carried out by Stripe (including identity and payout account details);
- have payments and payouts enabled at Stripe and no outstanding requirements.
- The verification status is determined solely on the basis of information provided by Stripe. BEON.RUN does not carry out its own identity verification and has no influence over Stripe's decisions.
- Support is available in every Plan (FREE, PREMIUM, PLATINUM) on the same terms.
- BEON.RUN may refuse to enable Support or disable it for the reasons described in § 11.
§ 3. Nature of Support
- Support is voluntary support given by a Supporter in connection with the Support Recipient's public content. Support is not a public collection, a charitable collection or crowdfunding. The Service documents do not determine the civil-law or tax characterisation of Support (§ 8).
- Support is not payment for any performance carried out at the Supporter's request. The Support Recipient may not offer any services, perks or commitments in return for Support (e.g. completing a particular route or distance, a shout-out on request, fulfilling a request, access to content not available to others). Reading out a message or displaying the Supporter's name is not a counter-performance, and the Support Recipient has no obligation to do so.
- Support gives the Supporter no rights against the Support Recipient or BEON.RUN.
- BEON.RUN does not guarantee any income from Support.
§ 4. How payments work
- A Support payment is processed by Stripe as a direct charge on the Support Recipient's Stripe Account. The seller (merchant of record) of the payment is the Support Recipient; their name may be visible to the Supporter in the payment form, the confirmation and the bank statement.
- BEON.RUN does not receive, hold or transfer Support funds. Payment processing, verification and payouts are performed by Stripe under its agreement with the Support Recipient.
- Payment methods (e.g. card, BLIK) depend on availability at Stripe. Currently the minimum Support amount is PLN 10 and the maximum single Support amount is PLN 500. In addition, a risk limit applies: the total Support from one Supporter to one Support Recipient may not exceed PLN 2,000 within any rolling 24-hour period. These values are set by BEON.RUN and may be changed; the current values are always shown in the payment form.
- The payment status in the Service reflects information received from Stripe. A payment is considered made only after Stripe confirms it.
§ 5. Platform fee and Stripe fees
- For providing the Support feature, BEON.RUN charges the Support Recipient a platform fee of 8% of the amount of each Support payment (the amount paid by the Supporter). 8% is the final amount deducted as the platform fee – BEON.RUN adds no further amounts to it (e.g. on a PLN 100 Support payment the fee is PLN 8). The Provider handles the tax treatment of the fee in its own accounting. The fee is deducted automatically by Stripe at the time of payment (application fee).
- The fee rate and amount in force at the time of the payment are recorded with that payment and do not change later. A future rate change never alters the settlement of earlier payments.
- A change of the fee rate applies only to payments made after it takes effect. BEON.RUN informs Support Recipients at least 30 days in advance through a durable notification in the Platform and, where available, also by e-mail; the change requires acceptance of the new version of the documents, and a Recipient who does not accept it may disable Support.
- Stripe payment processing fees (according to Stripe's pricing), dispute fees and other Stripe fees are borne by the Support Recipient; Stripe charges them separately from the platform fee.
- Examples and details are in the Fees and Payouts.
- Invoices for the platform fee are issued manually by the Provider where required by law. Invoices are not generated automatically in the Service; the settlement statement (§ 7) is not an invoice.
§ 6. Payouts
- Payouts to the Support Recipient's bank account are made by Stripe. Payouts are made on a monthly cycle: the payout of funds received in a calendar month is planned for the 15th day of the following month, provided that: the funds are available in the Stripe Account balance, the Stripe Account remains verified, payouts are enabled, there is no legal or risk block, the funds are not subject to a refund or dispute, and Stripe has not held the payout.
- If any condition is not met, the amount moves to the next settlement period. BEON.RUN does not guarantee a payout on any particular date.
- Stripe's minimum payout amounts and settlement periods apply.
§ 7. Settlement statement
- In the Service, the Support Recipient can see the current month (Support received, platform fee, Stripe fees, refunds, disputes, amounts to be paid out and paid out) and a monthly SETTLEMENT STATEMENT (ZESTAWIENIE ROZLICZENIOWE) in CSV and PDF format.
- The statement is for information only and is not a VAT invoice or a tax document. In case of discrepancies, the data at Stripe prevails.
§ 8. Taxes and the Support Recipient's obligations
- The Support Recipient is solely responsible for determining the tax nature of the funds received and for settling any taxes due (e.g. personal or corporate income tax, VAT or other taxes), filing returns and keeping records, as well as for any obligation to register a business.
- BEON.RUN does not represent that Support is tax-free, is not a tax remitter for Support and does not issue tax information forms (e.g. PIT-11). BEON.RUN does not provide tax advice.
- If the Support Recipient acts as a business, they are responsible for the legal requirements towards Supporters (e.g. trader information, documenting sales).
- DAC7: if BEON.RUN is deemed a reporting platform operator under the rules implementing Council Directive (EU) 2021/514, the Support Recipient will be required to provide the required data (e.g. full name, address, date of birth, tax identification number, account number), and BEON.RUN will report it to the Head of the National Revenue Administration. Failure to provide the data after two reminders may result in Support being disabled.
§ 9. Rules for using Support
- In particular, it is prohibited to:
- support oneself, including from other Accounts or through intermediaries, or artificially inflate Support or TOP lists;
- use Support for money laundering, terrorist financing, fraud, sanctions evasion or transferring funds between persons unrelated to the Recipient's content;
- collect funds for charitable purposes, public collections, crowdfunding or on behalf of third parties;
- offer services or perks in return for Support (§ 3(2));
- mislead as to the purpose of Support – Support goals (e.g. “new shoes”, “race entry fee”) must be truthful, and the Support Recipient must not claim that funds will be used for a purpose they will not be used for;
- solicit Support aggressively, from minors or by applying pressure;
- breach Stripe's rules (including its lists of prohibited and restricted businesses).
- Supporters' messages are moderated. The Support Recipient may hide messages attached to Support given to them, in particular messages that breach the Terms or the Content Moderation Rules; BEON.RUN may hide any message that breaches those rules. A hidden message is not displayed or read out. Hiding a message alone does not create an automatic entitlement to a refund and does not change the payment, the Support goal progress or the TOP list – these follow the financial state of the payment (e.g. a refund or a lost dispute). The Support Recipient may enable reading messages aloud (TTS) on their device, displaying a Support goal and a TOP Supporters list. A Supporter may support anonymously – their signature is then not shown publicly or to the Support Recipient in the Service and does not appear on the TOP list. The Recipient is responsible for what they publicly show and read out in the Stream.
§ 10. Refunds, disputes and chargebacks
- Refunds and chargebacks are charged to the balance of the Support Recipient's Stripe Account. On a refund, the platform fee is returned in proportion to the refunded amount (e.g. PLN 100 Support, PLN 8 fee, PLN 25 refund – PLN 2 of the fee is returned). If a dispute is lost and the payment reversed, BEON.RUN does not retain the platform fee on the reversed amount – the fee is returned. Stripe dispute fees are borne by the Support Recipient under Stripe's terms.
- The Support Recipient may initiate a refund of a Support payment made to them. BEON.RUN may carry out a refund in the case of a duplicate payment, fraud, a justified complaint, where required by law, or on the basis of a platform decision. Every refund is confirmed and recorded in the Service.
- A negative balance may be covered from future payments or collected by Stripe under the Stripe agreement.
- Details: Refunds and Chargebacks Policy.
§ 11. Suspension and termination
- BEON.RUN may hide the Support button or suspend the Support feature, in particular where: Stripe restricts the Stripe Account, the Recipient breaches these Terms, the Service Terms or the law, there is a reasonable suspicion of fraud or abuse, the Account has been suspended or banned, or a legal provision or an authority requires it. BEON.RUN provides a statement of reasons in accordance with the Content Moderation Rules, and the Recipient may appeal.
- The Support Recipient may disable Support at any time. Deleting the Service Account closes the Stripe Account and deletes or anonymises profile data and Support settings. Payment, refund, dispute, platform fee, settlement, payout and document acceptance records and data required by tax and accounting law are retained after deletion – detached from the Account and linked to a pseudonymous reference – for the period required by law or necessary to establish, exercise or defend claims (Privacy Policy, § 11 and § 12). After deletion the panel and settlement statements are no longer available in the Service – before deleting the Account, the Recipient should download any statements they wish to keep. Stripe keeps its own records under its own policy; settlement of earlier payments, refunds and disputes is governed by the agreement with Stripe.
- Disabling Support does not affect funds already held in the Stripe Account – their payout is managed by Stripe.
§ 12. Personal data
BEON.RUN shares with Stripe the data needed to create the Stripe Account and receives from Stripe information about verification status, account capabilities, payments and payouts. Verification data (documents, PESEL number, bank details) stays at Stripe – BEON.RUN does not store it. BEON.RUN records the acceptance of these Terms: the Account identifier, the document version, the date and time of acceptance and the IP address. Details: Privacy Policy, § 7.
§ 13. Liability
BEON.RUN is not liable for Stripe's actions and decisions (including verification, blocks, payout holds), for Supporters' decisions or for the Support Recipient's tax settlements. The Support Recipient is responsible for the lawfulness of their activity and content, including Support goals.
§ 14. Changes and final provisions
- Changes to these Terms, to the platform fee and to the payout rules are announced at least 30 days in advance through a durable notification in the Platform and, where available, also by e-mail, and require renewed acceptance. Until the new version is accepted, Support may be unavailable.
- The provisions of the Service Terms on governing law and complaints apply. The Polish version is binding.
