Content and Moderation Rules

These Rules describe which content is not allowed in the BEON.RUN service, how to report illegal content, how we make moderation decisions and how to appeal them. They implement, among others, Articles 14 and 16–18 of Regulation (EU) 2022/2065 on a Single Market for Digital Services (“DSA”). The Service is operated by Radosław Balcerzak, balcerzak.it RADOSŁAW BALCERZAK, NIP 7631978291 (“BEON.RUN”).
§ 1. Point of contact
- Single point of contact for Member State authorities, the European Commission and the European Board for Digital Services (Article 11 DSA) and for recipients of the service (Article 12 DSA): e-mail [email protected].
- You can communicate with the point of contact in Polish or English. Messages are read and handled by a human – not solely by automated tools.
- The same address is used for notices of illegal content (§ 4) and appeals (§ 6). The contact details are also available on the Contact page.
§ 2. Prohibited content and conduct
In the Service (Streams, recordings, chat, comments, profiles, routes, descriptions, Support goals and Support messages, events) the following are not allowed in particular:
- content that is illegal under Union law or the law of a Member State;
- content infringing copyright and related rights (e.g. streaming other people's music, films or sports broadcasts without authorisation), trademarks, image, personal rights or privacy of others;
- hate speech, threats, harassment, incitement to violence, terrorist content;
- pornographic content and sexual content involving or directed at minors;
- violence and cruelty, promotion of self-harm;
- promotion of dangerous behaviour, especially in road traffic;
- disclosure of other people's personal data, including location, without a legal basis;
- spam, fraud, impersonation, misleading Support goals and fundraising, offering services in return for Support;
- actions disrupting the Service or circumventing blocks.
§ 3. Moderation tools
- Automatically: the Service masks profanity in chat messages (e.g. “f***”) and rejects guest names containing profanity. Message rate limits and a duplicate block also apply. Support messages may not contain links. Other moderation decisions are made by a human; we do not use automated content removal or automated Account blocking.
- The Creator can, in their Stream: disable chat, delete messages, block an author in the chat and revoke their access to that Stream (for 24 hours). The Creator also decides whether Support messages are read aloud (TTS) and whether the Support goal and the TOP Supporters list are displayed, and as a Support Recipient can hide messages attached to Support given to them.
- BEON.RUN administrators can: remove content or restrict its visibility, end a Stream, disable chat, delete a recording, route or event, exclude an Account from lists and search, suspend an Account (read-only mode), ban an Account (no login), suspend Organizer status, disable the Support feature, hide any Support message. Measures may be temporary or permanent. Every administrator decision requires a reason and is recorded in the audit log.
- When choosing a measure we take into account the severity of the breach, its repetition, the effects on others and fundamental rights, including freedom of expression.
§ 4. Reporting illegal content (Article 16 DSA)
- Anyone – also without an Account – can report content they consider illegal by sending a message to [email protected].
- The notice should contain:
- a sufficiently substantiated explanation of why the content is illegal;
- the exact URL of the content (e.g. Stream, profile, Activity) and – if possible – the time or a description of the part (e.g. the time of a chat message);
- the name and e-mail address of the notifier – except for notices concerning child sexual abuse offences;
- a statement that the notifier believes in good faith that the information in the notice is accurate and complete.
- We confirm receipt of the notice if an e-mail address is provided. We process notices in a timely, diligent and objective manner and inform the notifier of the decision and the available redress.
- Streams are live – for notices about an ongoing Stream, say so in the subject line; we can then act immediately (e.g. end the Stream).
- A breach of the Terms that is not illegal can be reported the same way.
§ 5. Statement of reasons (Article 17 DSA)
If we remove or disable access to your content, restrict its visibility, suspend or ban your Account, disable Support or suspend your Organizer status, we will provide you – at the latest when the measure is applied – with a clear statement of reasons including: the type and scope of the measure (including its duration), the facts and circumstances, whether the decision was based on a notice and whether automated means were used, the legal ground (for illegal content) or the provision of the Terms (for breaches of the Terms), and the available redress. We do not provide a statement of reasons if we do not have your contact details or where an order of an authority or the law prohibits it.
§ 6. Appeal
- You can appeal a moderation decision (and a decision not to act on a notice) within 6 months by writing to [email protected], stating the address of the content or Account and your reasons.
- The appeal is reviewed by a human, other than the person who made the decision where possible. We respond without undue delay and no later than within 14 days. If the appeal is justified, we reverse the measure.
- BEON.RUN is a micro-enterprise; some obligations in Section 3 of the DSA (including Articles 20–23) may not apply to it (Article 19 DSA). We provide the appeal procedure voluntarily.
- Regardless of the appeal, you can pursue your rights in court or – where available – before a certified out-of-court dispute settlement body (Article 21 DSA).
§ 7. Repeated infringements and misuse
- A User who frequently posts manifestly illegal content may, after a prior warning, be suspended for a reasonable period or banned.
- A person who frequently submits manifestly unfounded notices may be temporarily prevented from submitting notices.
§ 8. Live chat and Support messages
- Logged-in Users and – in public and unlisted Streams – guests under a chosen name can write in the chat. In private Streams the chat is available only to the owner and administrators.
- Messages are short (up to 300 characters), without HTML, with profanity masking and rate limits. The Creator and administrators can delete messages and block authors.
- Support messages (up to 200 characters, no links) may be displayed publicly and read aloud (TTS) – the same content rules apply to them. Paying Support does not guarantee that the accompanying message will be published. The Support Recipient may hide a message attached to Support given to them, and BEON.RUN may hide any message that breaches these rules or the Terms; a hidden message is not displayed or read out. Hiding a message alone does not create an automatic entitlement to a refund of the Support and does not change the payment, the Support goal progress or the TOP list – these follow the financial state of the payment.
§ 9. Notifying authorities (Article 18 DSA)
If we become aware of information giving rise to a suspicion of a criminal offence involving a threat to the life or safety of persons, we promptly inform the competent law enforcement authorities and provide the information available.
§ 10. Orders from authorities
We act promptly on orders to act against illegal content and orders to provide information (Articles 9 and 10 DSA), inform the authority of the effect given to them and inform the User to the extent required by law.
